These Terms relate to your legal rights and responsibilities applicable when you use this site to book tourism, leisure and entertainment activities offered by independent suppliers who are partners of Justhost and indicated as such on our Site.

As a result, Justhost is not the provider of these activities but the partner, whose name is indicated on each product presentation.

Each booking of partner activities made on our Site implies full and complete acceptance of the General Terms and Conditions of Use and Sale.

These General Terms and Conditions of Use and Sale may be modified and updated at any time, without prior notice. It is imperative for the user to consult the website regularly. Updates apply once posted on the website. However, these modifications do not apply to orders previously accepted by our partners and confirmed by Justhost.

USE OF THE WEBSITE

This website is made available to you free of charge (excluding connection costs) for your personal use, subject to compliance with the Conditions of Use defined below. Your use of this website implies full and complete acceptance of all of its Conditions of Use.

Your use of this website is intended for personal and non-commercial use, and/or to make legitimate requests for the reservation of our various services. You agree not to use this site to make false, speculative or fraudulent requests. You agree not to use robots or other automated systems or means to access this site, except with special authorization issued by Justhost.

The purpose of the website is to assist the user in searching for tourism or travel services and to make the appropriate bookings. The user must be at least 18 years old, be legally able to contract, and use this website in accordance with the Conditions of Use.

You may use this website only to make reservations or purchases for a legitimate purpose. No other purpose, or diversion of this purpose, is permitted, particularly for purposes contrary to public order and good morals.

If these conditions are not respected, we reserve the right, by any means and without notice, to prohibit or restrict completely or partially your access to this website, without prejudice to any damages.

Except in cases of fraud, which you must prove, you are financially responsible for all actions taken on this website, particularly the use of your email address and password. You also guarantee the truthfulness and accuracy of the information concerning you that you have provided on our website.

Any copying, reproduction, republication, downloading, posting on the Internet, broadcasting, transmission, making available to the public or use of the content of the website (text, images, URLs, pricing information, etc.) for purposes other than personal and non-commercial is strictly prohibited. BOOKING OF SERVICES

Certain services marketed on the website are subject to availability. However, Justhost cannot guarantee the availability of all partner services for all proposed dates. No refund request can be processed if the chosen service is not available.

A reservation will be considered effective only from the moment the user receives the voucher (“contremarque”) confirming the order, and not the payment confirmation sent by Justhost SAS. The contract will therefore become effective only upon confirmation of the reservation by Justhost.

The user may place orders on the website only after having confirmed these general conditions, as well as the applicable specific partner conditions.

The order confirmation, which includes essential information such as the identification of the service(s) ordered and the price, will be sent to the user by email shortly after the order date. By printing and/or saving this email, the user will have a means of proving their order and the conclusion of the contract.

SERVICE PRICES

The prices stated for Services on the Site, except for the cart, are expressed per person in euros. Unless otherwise indicated, prices include all taxes.

Prices may change without notice and become final only after the user receives confirmation of their purchase. Displayed prices are not a guarantee in themselves. They are provided for information purposes only, notably for foreign currencies.

Prices include all services indicated in the description of each excursion, visit or activity.

Prices stated on the website are valid only for reservations made on the site, directly online.

Promotions mentioned on the website are valid only on the website. They cannot be sold through another distribution channel. They meet certain characteristics, particularly regarding dates, which will be mentioned. Certain transactions may be subject to bank fees. It is therefore the user’s responsibility to contact their bank for information on the corresponding amounts and conditions.

PAYMENT TERMS

Payment must be made at the time of booking the Services by bank card using the secure payment system implemented on the website.

To confirm a reservation, payment must be made in full.

The price corresponding to the booked services is charged to the bank card.

For an order of services that could not be confirmed due to lack of availability, the price corresponding to the service will, where applicable, be credited to the cardholder’s bank card within 5 business days following validation of the order.

Only the following payment cards are accepted on the website: MasterCard, Visa.

PROCESSING AND CONFIRMATION OF SERVICE ORDERS

Justhost will process the User’s reservation within an average period of two business days (an average period also dependent on partner responsiveness) from validation of the order.

Once the availability of the ordered service has been confirmed by its partner, the final confirmation of the user’s order is sent via the voucher (“contremarque”) that Justhost has sent to the email address provided by the user on the website. This voucher contains all information relating to the corresponding service as well as a withdrawal form, when the situation allows.

The user is required to check their email, or the website if permitted, to access their voucher and is solely responsible for printing it.

The user must print their voucher and present it to the service provider to enable the reservation to be honored.

In order to prevent fraudulent use, an identity document may be requested, as well as the signature on the voucher or the presentation of the bank card used for the order.

A bank statement cannot in any case constitute proof of purchase.

If the chosen service is not available, the user is informed within 72 hours following validation of their order and the amount actually paid for the service is refunded to their account within 5 business days thereafter.

No compensation claim may be made if the chosen service is not available.

BOOKING MODIFICATIONS

Ticket reservations and guided services are considered sales of leisure services and, in accordance with Article L 121-28-12° of the French Consumer Code, do not give rise to any right of withdrawal. For this reason, all sales are final, and no modification or change can be made by the user.

BOOKING CANCELLATION

For this reason, all sales are final and no refund may be made in the event of cancellation by the user.

No interruption of a tour or service by the user will give rise to a refund. Any user arriving after the departure time of the service will be considered a “no-show” and will not be entitled to a refund, whatever the reason for their delay.

Partners reserve the right to cancel or modify certain tours without notice if traveller comfort or safety requires it, in cases of force majeure, strike, demonstration, administrative decision or exceptional closure, etc. Justhost cannot be held responsible for such decisions. In such a situation, Justhost will do its best to inform the user and find the most appropriate solution. This information will be sent in writing to the user, who must express their choice as soon as possible. If the company’s new proposals do not satisfy the user, he/she may request a full refund for the service booked on the site, specifying the reservation number that was communicated to them.

COMPLAINTS

Any complaint must be received by Justhost within 15 days following the date on which the service in question was performed. Complaints must be formalized by completing and sending, via the site, the dedicated form made available to you on the “Contact us” page.

MEDIATION

In accordance with Article L. 612-1 of the French Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the option to submit a request for amicable resolution by mediation, within a period of less than one year from their written complaint to the professional.

JUSTHOST has designated, by membership registered under number 53351/VM/2407, SAS Médiation Solution as the consumer mediation entity.

To refer the matter to the mediator, the consumer must submit their request:

The postal, telephone and electronic contact details of the applicant,

Copy of the prior complaint,

Any documents enabling the request to be examined.

DATA PROTECTION AND FREEDOMS

LIABILITY

Tour times, programs and duration may change, and prices include all services indicated in the description of each service.

PHOTOS AND ILLUSTRATIONS

Every effort is made to provide photos and illustrations giving the client an overview of the services offered. The purpose of these photos and illustrations is to indicate the accommodation category or level of comfort to the user and may not give rise to any commitment beyond this objective.

Justhost and its partners cannot be held responsible and cannot guarantee the return of personal effects and luggage forgotten in coaches, minibuses or any other place.

It is the user’s responsibility to check that they have all documents required for the ordered service and, in particular for excursions outside France, that they have a passport with a visa if necessary or a valid identity card.

No refund may be made in the event of absence (or loss) of the required documents.

Smoking is strictly prohibited in coaches and minibuses (law of September 17, 1977).

DATA PROTECTION

Information communicated by the client on the website enables the processing and execution of their orders.

In accordance with European regulations, information necessary for processing and executing orders is indicated by an asterisk on the website pages.

Other requests for information calling for an optional response or concerning the client’s interest in offers that may be sent to them are intended to better understand them and improve the services offered.

APPLICABLE LAW

These terms are subject to French law and in particular the French Tourism Code. Any dispute relating to their interpretation and/or execution falls within the jurisdiction of the French courts.

GENERAL PROVISIONS

If, at any time, Justhost does not invoke any of the provisions of these General Terms, this may in no case be interpreted as a waiver by Justhost of its right to invoke it later.

If one of the provisions of the General Terms is declared null or ineffective, it will be deemed unwritten, but this will not affect the validity of the other provisions, unless the provision declared null or ineffective is essential and decisive.

The user acknowledges having been informed that, under Article L 121-28-12° of the French Consumer Code, all Services offered on the site are not subject to the application of the right of withdrawal provided for.
